DMCA Policy – Creativecustomworld

At Creativecustomworld, we provide a platform for users to design and sell custom merchandise. We take intellectual property rights seriously and prohibit users from creating or selling products that infringe upon the intellectual property of others, including but not limited to copyright and trademark rights. If you believe your intellectual property has been violated by a user on our platform, please follow the steps outlined below to file a DMCA complaint.


A. How to Report Intellectual Property Infringement

Creativecustomworld’s policy is to:

  1. Block access to or remove any content that infringes on third-party intellectual property rights upon receiving a compliant notice.
  2. Terminate the service of repeat offenders.

To file a copyright infringement notice or report a violation of intellectual property rights, provide the following information to our Designated Agent:

  1. Identification of the copyrighted work or intellectual property being infringed, including registration numbers if applicable.
  2. Details of the infringing content, including (a) a description of how it violates your rights and (b) the location of the infringing content on the Creativecustomworld platform.
  3. Your contact information (name, mailing address, phone number, and email).
  4. A statement affirming your good faith belief that the use of the content is unauthorized.
  5. A statement, under penalty of perjury, that your notice is accurate and you are authorized to act on behalf of the rights holder.
  6. Your electronic or physical signature.

B. What Happens After You Submit a DMCA Notice?

Upon receiving a valid notice of infringement, Creativecustomworld will:

  1. Remove or disable access to the infringing content.
  2. Notify the user responsible for the content.
  3. Terminate the accounts of repeat infringers.

C. Filing a Counter-Notice

If you believe your content was wrongfully removed, you can submit a counter-notice. Your counter-notice must include the following:

  1. Identification of the content that was removed, including the original location on the Creativecustomworld platform.
  2. A statement under penalty of perjury that you believe the content was removed in error.
  3. Your contact information (full name, address, phone number, and email).
  4. A statement that you consent to the jurisdiction of the Federal Court in your district or where Creativecustomworld is located, and that you will accept legal service from the complainant.
  5. Your electronic or physical signature.

Upon receiving a counter-notice, Creativecustomworld may restore the removed content within 10 to 14 business days, unless the original complainant takes legal action.


Important Notice

Under Section 512(f) of the DMCA, any person who knowingly misrepresents content or activity as infringing may be liable for damages, including legal fees. Please ensure your claims are accurate before submitting a notice or counter-notice.
